Am I obligated to show up for my appointment?
- A:
Yes. When you book an appointment you enter into a contract with the service provider (the Salon). Not turning up for the appointment is a breach of that contract. If there is a financial loss to the Salon as a result of being unable to refill that appointment, they can recover the loss from you.

Are the services on offer at FIXY discounted and how do I know if they are discounted?
- A:
At FIXY we aim to bring you the best prices, however not all of our services are discounted. We believe the FIXY customer is discerning enough to know a good deal when they see one. You will be booking with the best salons in town, so if the price feels right for you, then it's a good fit. We also believe there are enough sites promoting mass discounts and that's not really our game.

Are you just another daily deal site?

No we are not! We are extremely passionate about providing a website designed with the consumer and salon in mind. A place for salons to shift unproductive time and for the FIXY visitor to benefit from preferential prices during off-peak salon times.

Can I book a FIXY service for somebody else?
- A:
Indeed you can! We recommend just booking the service under their name and also making sure the service you are booking is something they really want, as the salon is under no obligation to change the service you have booked.

Can I ring the salon direct to book the offer I have found on FIXY?
- A:
No, you can’t validate the offers you see on FIXY direct with the salon. These offers are exclusive to FIXY, which you can book through the FIXY website.

No not at all! Jump on in, make a booking and if you like what we do, go ahead and sign up! If you do sign up, we promise not to hound you like the fox that you are, instead we will just keep you up to date from time to time with exciting FIXY news that is relevant to you.

I have booked a service via FIXY, now what?
- A:
Once you have made your booking you will receive an email confirmation that will have all the information you require for your appointment. Please print this confirmation out and take it with you to your appointment.

Feel free to contact the salon but the nature of how the site operates means that once you have booked the salon is under no obligation to change the service. However, if the salon can make it work, they will.

We recommend discussing this with the business manager. Most salons want the opportunity to put a situation right so you, the customer, are happy.

Legal & terms of sale
Published 28 March 2012Fixy Limited (“Fixy”) is the operator of the website www.fixy.co.nz (“the Fixy Site”). By using and purchasing Appointments on the Fixy Site, you agree to be bound by these terms and conditions (“Terms”). Please read the Terms carefully.
1. What We Do
The Fixy Site advertises for sale specific health and/or beauty services available in real-time and time-specific appointments (the “Appointment”) with third party salons (each a “Salon”). Users of the Fixy Site (“You”) book Appointments and attend the Salon at the time and date specified in the Appointment, for the services described in the Appointment. You may print an appointment confirmation from the Fixy Site to show to the Salon as evidence that the Appointment has been secured. Fixy provides this service to you subject to your acceptance in compliance with these Terms.
2. Who You Are
You must be at least 18 years of age and in possession of the legal right and ability to legally contract with Fixy and You represent and warrant the same by accepting these Terms.
3. Your Conduct
You agree not to do any of the following (either directly or indirectly) while using the Fixy Site:
(a) interrupt the operation of the Fixy Site in any way or to use the Fixy Site in a way which adversely impacts on other users of the Fixy Site;
(b) transmit any unsolicited advertising, promotional materials or any other forms of solicitation, unless expressly authorised by Fixy;
(c) breach any applicable law or regulation;
(d) engage in any other conduct whatsoever that Fixy considers, in its absolute discretion, breaches these Terms or is otherwise inappropriate, illegal, fraudulent or unauthorised.
4. Appointments
Information displayed on our site regarding the Appointments is provided by the specific Salon and not within our control. Subject to clause 8, Fixy does not endorse, warrant or make any representation whatsoever about any Salon or about any services provided in an Appointment by any Salon through the Fixy Site. Fixy takes no responsibility for the information provided by a third party Salon or for any inaccuracy for omission in that information. You agree and acknowledge that Fixy cannot be liable or responsible for any errors, inaccuracies or misrepresentations in information relating to services supplied to the Fixy Site by a Salon and other third parties.
Appointments are time specific and service specific and You are responsible for attending your Appointment at the correct Salon and at the correct time. Any amendments or alterations You may require to an Appointment must be negotiated directly with the Salon. You agree and acknowledge that whether a Salon agrees to amend or alter an Appointment is entirely at its discretion and is not the responsibility of Fixy. You are responsible for ascertaining whether an Appointment is appropriate for you given the appointment time and description of services provided via the Fixy Site and any further enquires you may make of the Salon. Subject to clause 8, Fixy will not be responsible for any refunds whatsoever.
You acknowledge that a component of the price for an Appointment may include a booking fee and that Fixy receives a commission for its services in relation to the Appointment.
5. Intellectual Property
You acknowledge that all content displayed or made available through the Fixy Site (including without limitation any software, data, information, picture, graphics or other materials) is the property of Fixy or owned by third parties and used with express permission of the copyright or trade mark owner. You do not receive any intellectual property rights in the content described and no content may be reproduced, published or transmitted without Fixy’s written consent.
6. Other Websites
Fixy is not responsible for the content of any other website linked to or from the Fixy Site.
7. Operation of Website
Fixy and its service providers do not make any warranty whatsoever that the Fixy Site or services will be free of error, free of any interruption or delay, secure or free of any defects in design. Fixy makes no warranty that the Fixy Site will meet your requirements nor that the quality of any services or information obtained by you through the Fixy Site will meet your requirements. Fixy takes no responsibility for any unavailability of the Fixy Site or for any loss you may incur as a result of the Fixy Site being unavailable. Fixy takes no responsibility for any damage caused to You or your computer system as a result of your use of the Fixy Site.
You agree and acknowledge that any information or material downloaded or obtained thorough the use of the Fixy Site is assessed at your own risk and you will be solely responsible for any damage to you or your computer system (including loss of data) as a result of your downloading or your use of this material.
8. Limitation of Liability
The Consumer Guarantees Act 1993 and other legislation may impose obligations or implied warranties or conditions which are unable to be excluded, restricted or modified. These Terms must in all cases be read subject to such statutory provision. Subject to such statutory provisions, Fixy excludes all responsibility in relation to the services supplied to you by a Salon in relation to an Appointment. Fixy does not give any guarantee, warranty or representation (express or implied) in relation to an Appointment, services provided under an Appointment or your use of the Fixy Site. Where any such liability cannot be excluded then Fixy limits its liability to the price You paid for the Appointment and will not be liable to You for any damages or loss (including but not limited to direct, indirect or consequential losses including third party loss, loss of profits, loss of revenue, loss of opportunity), costs or expenses of any kind which arise as a result of the Fixy Site.
9. Indemnity
You agree to indemnify Fixy, its officers, directors, employees, shareholders, agents, affiliates, subsidiaries, suppliers and representatives against any and all claims, damages, losses, costs and expenses (including but not limited legal fees) resulting from any violation of these Terms or any activity related to your use of the Fixy Site (including negligent or wrongful conduct) by You or any other person accessing the Fixy Site using your account.
10. Privacy Policy
You accept that Fixy collects personal information about You and users of the Fixy Site. This information includes your personal information provided when registering your account, information You provide when booking an appointment and data relating to your use of the Fixy Site (“personal information”).
Fixy may use your personal information to monitor, maintain and improve the Fixy Site.
Fixy will disclose required personal information to the Salon specified in any Appointment you book in order to facilitate the delivery of that Appointment. Fixy will also disclose your personal information to companies whom we contract to process bookings for Fixy Site users in order to facilitate booking of an Appointment. In all other circumstances, Fixy will not disclose your personal information to any other third party without your consent.
Other than emails required to advise you of your purchase of an Appointment, You will be given an option to elect to receive email correspondence from Fixy which You are able to unsubscribe from at any time.
11. Termination
In the event that Fixy has grounds to suspect that you are in breach of these Terms, then Fixy can suspend or terminate your access to the Fixy Site without notice and prohibit your future use of the Fixy Site. Fixy may at its sole discretion determine whether immediate and permanent termination of your use of the website is appropriate.
12. Amendments to These Terms
Fixy may update, amend, alter or change these Terms at any time. The new and updated Terms will be found on the 'FACTS' page of the Fixy Site and by continuing to access the Fixy Site after these updates have been notified, you agree to be bound by the amended Terms.
13. Terms
These Terms are governed by and construed in accordance with the laws of New Zealand. Each party irrevocably and unconditionally submits to the non-exclusive jurisdiction of the courts of New Zealand.
If any provision of these Terms or portion thereof is found to be illegal, invalid or unenforceable, that provision will be enforced to the maximum extent permissible by law so as to give effect the intent of the Terms and the remainder of these Terms will continue in full force and effect.
These Terms and rights granted and obligations undertaken hereunder may not be transferred, assigned or delegated in any manner by You. Fixy may assign its rights and duties under these Terms to any party at any time without notice to users.
Any failure by Fixy to insist upon or enforce strict performance of any provision of these Terms will not be construed as a waiver of any provision or right. The course of conduct between Fixy and You and/or trade practice will not act to modify any provision of these Terms. -

Definitions• "we" or "FIXY" means FIXY Limited and its authorised agents
• “our/the site”, “our/the website”, “our/the system” means the web application located at http://www.fixy.co
• “suppliers” means the salons, artists and providers other services offered on the FIXY web application
• "services" means all goods or services our suppliers provide and anything else they do for you
• "you" means you, the person using supplier services, or visiting our website
Collection, storage and use of your information
In addition to the information that you provide when registering with our site, we collect and store information about your use of fixy.co, including your IP address, the operating system and the browser your computer uses, search engines and referring sites, date, time and pages visited. We use that information to measure the number of visitors to different parts of the site and to facilitate optimisation of our system’s user experience and performance.
FIXY also collects and stores the purchasing history and product preferences of our customers. This information may be used to find and offer other relevant/related services on behalf of our suppliers - but only while using our website. Unless you have given your express permission, it will not be used by FIXY to enable suppliers or other third parties to directly or indirectly offer their products or services to you by email or any other media.
We may publish aggregated information about overall usage patterns but we do not disclose, sell or otherwise distribute information about individuals or their computers to any third party. Where required by law, we must disclose information to relevant law enforcement authorities, such as the Police or the Department of Internal Affairs.
Accessing and updating your information
You have the right to access and correct of personal information that we hold. You are able to directly update your details by logging in to the site and accessing your account area.
Opting out of email communications
You can unsubscribe ("opt out") from email communications by following the unsubscribe instructions in the email.
Cookies
FIXY's website places a cookie on the hard drive of your computer. A "cookie" is a file that allows FIXY to track and target the interests of users. While we recommend that users enable cookies on their browsers in order to enjoy all the features of the site, the decision remains in the hands of the individual. Refer to your browser help menu for further information on cookies, as each user’s configuration is managed locally.
Changes to this policy
We may change any part of this policy at any time by changing or removing existing terms or adding new ones. We will tell you about any changes via the site and/or email.
Relevant law and jurisdiction
